The Right to Compensation

Some people have been misled have taken financial decisions based on the misleading information they received. The Department must therefore consider claims for compensation from people who:

• were given incorrect or incomplete information about SERPS inheritance, either directly or indirectly*, by a Government source (an indirect source could include a person or an organisation acting on Government information).
• relied on that information to make decisions about their financial arrangements and
• had they known the true facts, might have done something differently

* Indirectly could be from:

• Another Government Department or Agency
• A Voluntary Organisation, e.g. Citizens Advice Agency or Age Concern etc.
• A professional advisor, a Pensions Advisor or Financial Advisor
• Other – e.g., your employer

This list is not exhaustive.

Answer all the questions that apply to you as fully as you can. If you have any other information which you think may help your claim, please use the space at the end of the questionnaire.

If you have any documents that show you were given incorrect or incomplete information about SERPS inheritance, please list in the space at the end of the questionnaire. For example, you may have a leaflet or a letter from a social security office or a forecast you obtained concerning your State Pension. Do not worry if you do not have documentation, you can still make a claim.
